The most useful thing to know first: your visa does not decide your tax residence. Two different bodies of law, two different tests. Assuming they move together is the single most common misunderstanding we see.
183 days — and the test that ignores days entirely
The familiar rule is spending more than 183 days of a calendar year in Spain. The less familiar one is the centre-of-economic-interests test: if the core of your activities or economic interests sits in Spain, residence can follow without any day count at all. People who plan carefully around 183 days and stop there sometimes discover the second test was the one that applied.
Reporting foreign assets: Modelo 720 and Modelo 721
Once you are a Spanish tax resident, assets abroad may have to be declared — separately from being taxed. Modelo 720 is informative, and it triggers per category:
- bank accounts abroad;
- securities, rights and insurance abroad;
- real estate abroad.
When any one category exceeds €50,000, everything in that category is reported. The deadline is 31 March for the previous year's position. Modelo 721 does the same job for virtual currencies held abroad through a custodian, measured at 31 December.
You may have read that Modelo 720 was struck down. What the Court of Justice of the EU struck down in January 2022 was the penalty regime and the unlimited limitation period. Since 11 March 2022 the ordinary sanctions of the Ley General Tributaria apply instead. The filing obligation itself survived intact.
